What is a Residential Lease Guaranty?

A Residential Lease Guaranty, also known as a “Lease Guaranty” is a written promise to perform the obligations of a tenant in the event the tenant fails to meet its obligations of contractual performance in the lease.

The purpose of a Residential Lease Guaranty Agreement is to approve a prospective tenant for occupancy who would otherwise be rejected, or to simply give a landlord an additional party who agrees to be responsible for the lease in the event of a default.

A. Lease Description

This section states that in consideration of the landlord’s leasing the property to the tenant, the undersigned guarantors guarantee the performance of all tenants under the lease described below.

B. Payments

This section states that if the tenant fails to make any payment under the lease, the guarantor will, upon demand, make such payment to the landlord or the landlord’s agent. Payments under the lease include but are not limited to rent, late charges, returned check charges, attorney’s fees, repair costs, pet charges, utility charges, reimbursements to the landlord, maintenance charges, charges for property damage, and other costs or charges specified in the lease. If the tenant otherwise breaches the lease, the guarantors will, upon demand:

• Cure the breach as the lease may require of the tenant.
• Compensate the landlord for the landlord’s loss resulting from the breach.

C. Duration and Notices

This section states that this guarantee applies when the lease commences and continues until the lease ends, including any extension or renewal of the lease. The guarantors waive any rights to receive notice of any acceptance, modification, amendment, extension, renewal, or breach of the lease.

D. Joint and Several Liability

This section states that the guarantors are jointly and severally liable for all provisions of this guaranty.

E. Attorney’s Fees

This section states that any person who is a prevailing party in any legal proceeding brought under or related to this guarantee is entitled to recover attorney’s fees from the non-prevailing party.

F. Severability

This section states that if any term of this agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then this agreement, including all of the remaining terms, will remain in full force and effect as if such invalid or unenforceable term had never been included.

G. Application to Verify Creditworthiness

Mark the appropriate space if in this section the guarantors WILL or WILL NOT submit an application that authorizes the landlord or the landlord’s agent to verify information related to the guarantors’ creditworthiness.

This section also states that the guarantors may request a copy of the above-referenced lease at any time from the tenant of the broker of the lease.
